Terms of Service
The agreement between you and Aruga when you use our family safety app, websites, and services.
Important safety notice
Aruga is a complementary safety tool. It is not a replacement for emergency services. In a life-threatening emergency, always contact your local emergency number (Philippines: 911) first.
Welcome to Aruga. These Terms of Service govern your access to and use of the Aruga mobile application, our websites (aruga.io, track.aruga.io, auth.aruga.io), and related services. By creating an account or using Aruga, you agree to be bound by these Terms.
Acceptance of Terms
By downloading, accessing, or using Aruga, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.
These Terms form a legally binding agreement between you and [ARUGA ENTITY NAME], a company organized under the laws of the Republic of the Philippines, with principal office at [BUSINESS ADDRESS].
Eligibility
You must be at least 13 years old to use Aruga. If you are between 13 and 17 years old, you may only use Aruga with the express consent and supervision of a parent or legal guardian.
By creating an account, you represent that all registration information you provide is accurate, current, and complete.
The Service
Aruga is a family safety application that provides:
- Emergency SOS alerts to your designated trusted contacts
- Location sharing with friends and family during an active alert
- Trusted contact network for safety events
- Push notifications for urgent safety events
- Tracking links showing your live location during an emergency
We may add, modify, or remove features at any time. We will notify you of significant changes via in-app notice or email.
Your Account
To use most features, you must create an account by providing an email address, password, full name, mobile number, and other required information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized use
- Keeping your contact information accurate and up to date
SOS and Location Features
By using Aruga's SOS feature, you acknowledge and agree that:
- Aruga is not an emergency dispatch service. SOS alerts are sent only to contacts you have added.
- Alert delivery depends on internet connectivity, push notification servers, and the recipient's device.
- Location accuracy depends on GPS signal, device hardware, and environmental factors.
- False or test alerts may cause unnecessary alarm to your contacts.
- Tracking links may be shared by you with anyone, including non-Aruga users.
Acceptable Use
You agree NOT to:
- Send fake, prank, or test SOS alerts that could cause unnecessary alarm
- Use Aruga for any unlawful purpose
- Stalk, harass, threaten, or intimidate any person
- Track someone's location without their knowledge and consent
- Impersonate another person or misrepresent your identity
- Attempt to gain unauthorized access to other accounts or our systems
- Reverse engineer, decompile, or interfere with the Service
- Use automated tools to access the Service
- Violate the privacy, intellectual property, or other rights of others
User Content
Any content you provide, including profile information, custom SOS messages, photos, or feedback, remains yours. By submitting it to Aruga, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit it solely to operate the Service.
Intellectual Property
All rights, title, and interest in and to Aruga, including the name “Aruga,” the logo, the app, the websites, all designs, code, content, and features, are the exclusive property of [ARUGA ENTITY NAME] and its licensors.
Aruga Pro (Subscriptions)
Aruga may offer paid subscription features (“Aruga Pro”) such as SMS notifications, extended history, and others. Subscription terms, pricing, and billing cycles will be presented to you before purchase.
Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled by the platform you purchased through.
Third-Party Services
Aruga uses third-party services including Firebase (Google), Vercel, Resend, PayMongo, and Semaphore. By using Aruga, you also agree to comply with their respective terms.
Privacy
Your privacy is important to us. Our Privacy Policy explains what information we collect, how we use it, and your rights.
Disclaimers
Aruga is provided “as is” and “as available” without warranties of any kind.
To the maximum extent permitted by law, we disclaim:
- Any warranty that the Service will be uninterrupted, error-free, or secure
- Any warranty of merchantability, fitness for a particular purpose, or non-infringement
- Any guarantee of SOS alert delivery, location accuracy, or response time
- Any responsibility for the actions or inactions of your trusted contacts or third parties
Limitation of Liability
To the maximum extent permitted by Philippine law, Aruga shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total cumulative liability shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) PHP 5,000.
Indemnification
You agree to indemnify and hold harmless Aruga from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.
Termination
You may stop using Aruga and delete your account at any time through the app Settings. Upon deletion, your personal data will be removed according to our Privacy Policy.
We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms.
Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute shall be resolved exclusively in the competent courts of [CITY OF FILING], Philippines.
Before filing any formal claim, you agree to first contact us at legal@aruga.io to attempt good-faith resolution.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the app, email, or by posting a notice on aruga.io at least 14 days before changes take effect.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
